We at Dodge & Vega would like to take a moment to communicate our commitment to doing what we can to keep our team and the broader community safe during this rapid evolving COVID-19 situation.

First and foremost we are doing our best to make thoughtful decisions based on the most current information available, monitor the situation in real time and commit to you that we put the health of our clients, our team, and the community first. We are following the recommendations from the Centers of Disease Control and Prevention (CDC) and World Health Organization (WHO) and recommend you do as well.

What we at Dodge & Vega are doing to minimize the risk of infection, keep our team safe while still relentlessly pursuing your case:

  • No Contact: We have increased awareness and practice of social distance within and outside our company. Naturally this includes a policy of no handshakes, and no physical contact in general between employees, clients, and vendors.
  • No Face to Face: We have suspended all in-person consultations and meetings until further notice. Our clients and potential clients may still meet with us telephonically.
  • No Entry: We are limiting non-employees from entering our building. Clients who must drop off documents, payments, etc. can do so with our secure document “night drop” box we have now installed right next to our front door. Vendors will drop off in the front of our building as well.
  • Court Hearings: We will continue to appear as scheduled in court. However, whenever a telephonic appearance can be granted on a case by case basis by your judge we will pursue asking for one. We will seek to obtain permission to appear telephonically for our Dodge & Vega team as well as our clients. Please continue to appear in person in court as scheduled unless notified by our office that you may appear telephonically.
  • Physical Office Presence: We have instituted a remote working policy for those who can at Dodge & Vega. However, we remain open during our regular business hours with employees in our office still working on your case. We will continue to prepare and advance your case and may do so both remotely and physically in our office.
  • Cleaning: We have strengthened our cleaning and sanitation practices all throughout the office and beyond with personal work spaces sanitized and cleaned several times per day.
  • Sickness: If any of Dodge & Vega employees feels sick, they will stay home and contact the doctor immediately.

We also understand that scientists and public health experts are still learning daily about the nature and evolution of the COVID-19 virus. We will monitor the situation in real time and we commit to continue our communication with you as we all adapt to these global issues. Your safety, our safety and your legal needs remains our highest priority.

In Arizona, both Chapter 7 and Chapter 13 bankruptcy is used to discharge debt and give debtors a fresh start. However, Chapter 7 bankruptcy is the quicker and cheaper route to your debt free life. It is by far the most preferred bankruptcy for consumers and the average American out there. Because it is the most preferred bankruptcy method, there have been quite a few people over the years who have tried to fraudulently rack up debt and file bankruptcy even though they had plenty of money to pay their debts. So in 2005, to deter fraud, the Bankruptcy Court created the “Means Test” under the Bankruptcy Abuse Prevention and Consumer Protection Act. Essentially the Means Test determines whether your Chapter 7 filing is “presumed to be abuse.” It is the hurdle you must jump to file your Chapter 7 bankruptcy. When you file a Chapter 7 bankruptcy most all of your debts can be completely wiped out. So if a person filing bankruptcy actually has the money to pay back their debts, filing for Chapter 7 relief would be presumed to be abuse, or unfair. If you fail the means test then you most likely can still file a bankruptcy, but this time it would need to be a Chapter 13 bankruptcy.

The Means Test itself requires you to be poor enough to qualify for Chapter 7 bankruptcy in Arizona. There are average income levels you must fall under and/or use in calculating what necessary living expenses are allowed for a family of your size in your same county. The test is also used to determine whether or not your income could be used to pay off debts. Unless otherwise exempt, you must qualify under the bankruptcy Means Test in Arizona to even file for Chapter 7 bankruptcy relief. How do you know if you are exempt? You may be exempt from the Means Test if what you owe is primarily debt all based on your own business. For example, if you are self employed and you have a business line of credit and business credit cards, business leases, etc. and that is all more of a percentage of debt than your personal credit cards, etc. then you may be exempt from the Means Test. The money you lost when the company filed for bankruptcy would also be business debt. Other exemptions specifically relate to falling into debt during military service for those such as disabled veterans or active duty National Guard/Reservists.

Arizona Bankruptcy Means Test Median Income Figures

What are the Arizona Median Income Levels? They change often. As of May 1 2020 the Median Income numbers used in your Arizona Means Test calculations are as follows:

Household Size Monthly Income Annual Income
1 $4,282.33 $51,388.00
2 $5,378.58 $64,543.00
3 $5,869.00 $70,428.00
4 $7,116.92 $85,403.00
5 $7,866.92 $94,403.00
6 $8,616.92 $103,403.00
7 $9,366.92 $112,403.00
8 $10,116.92 $121,403.00
9 $10,866.92 $130,403.00
10 $11,616.92 $139,403.00

Don’t Do The Means Test Alone. Arizona Bankruptcy Lawyers at Dodge & Vega are here to help you now.

Arizona Bankruptcy Means Test Calculator

Like many other things in our culture, there are no shortage of Means Test calculators available all over the internet. It is important that no matter which Arizona Means Test Calculator you use, that it is up to date with the correct figures according to bankruptcy laws.

Step 1. Determine whether your income is below Arizona’s median income level. Arizona bankruptcy law requires you to look at the 6 months of your income immediately prior to your filing. Calculate your monthly income for the six months before filing for bankruptcy and compare it to the median income for households of your size in Arizona (see the above chart). Ensure that you are correctly calculating your income and that you are including ALL of your various income when comparing it to the income levels in Arizona. If you fall below the income levels of households of your size in Arizona, then you have passed the Arizona Means Test and automatically qualify for Chapter 7 bankruptcy relief! However, if your income ends up being above the median income level in Arizona, then you will need to complete the Means Test Calculation bankruptcy form.  This is where it can get tricky. A qualified bankruptcy lawyer at Dodge & Vega PLC will be very helpful in determining your income as well as completing the means test calculation for you.

Step 2. Complete The Means Test. The Means Test Calculation is just math and it calculates your disposable income by adding up your monthly expenses and subtracting them from your monthly income. The whole reason we do this math is because the bankruptcy law requires us to determine whether you have any money left over each month to pay down some of your debt. Any excess income above and beyond what Arizona Bankruptcy law deems as reasonable and necessary living expenses (allowable living expenses) is presumed to best used to pay towards your debts. You can see how important it is to make sure you have the correct information with your allowable living expenses. A qualified bankruptcy lawyer at Dodge & Vega PLC will be best at helping you see where your money goes every month and whether or not it is even an “allowable” bankruptcy living expense. We have see so many good people spending money on their kids for things like college tuition, extra curricular activities and more, that are all routinely denied by the bankruptcy court. This math is so critical to get so you have negative disposable income at the end of each month in order to qualify under the Means Test Calculation. Chapter 7 Bankruptcy is limited to those who are too poor to pay their debts back and not everyone is eligible or qualified to file a chapter 7 Bankruptcy. The intention behind Chapter 7 is to limit it to only those people who cannot genuinely afford to pay back their debts. If after The Means Test Calculation you have positive income (money left over), then it triggers the “presumption of abuse” of the bankruptcy laws and you will not be allowed to file a Chapter 7 Bankruptcy. All of this because according to the “math” you have money left over to pay down your own debt.

Step 3. Call us, let us help you get qualified. If you haven’t figured out yet how tricky this can be then think again. It truly is best to have a qualified Arizona bankruptcy lawyer look into your particular situation and details of your debts and income and living expenses. A good bankruptcy lawyer will be able to tell how to apply the bankruptcy law in your personal situation and maximize your ability to qualify under The Meas Test. Our telephone number is answered 24/7 480.656.8333, we are here to help.

Have you been sitting on the fence deciding on filing bankruptcy or not? There are a lot of people who push this off because of fear of everything they will LOSE. No one likes to lose out on anything, especially when you feel like that is all you have to your name. Although there will always be assets you might lose in your bankruptcy, there are a lot of things that you are allowed to keep during the bankruptcy process. It is actually pretty rare that an average family loses any property during their bankruptcy. The bankruptcy laws allow for lots of your property to be “exempt” – meaning that the court can’t take it from you.

If you were not aware (which most people are not), there are federal and state exemptions that protect you from losing some assets. There are different rules for chapter 7 bankruptcy compared to a chapter 13 bankruptcy. Both under both chapter 7 and chapter bankruptcies you will find that most if not all of your property can be legally protected if you are using a good bankruptcy lawyer. There are too many examples to give for every type of property, but one common question we get is about your house. For example, the federal exemptions allow you to keep $150,000 worth of equity in a home (if owned outright), meaning you don’t have to lose your home just because you are filing bankruptcy. There are other exemptions regarding your household goods, clothes, jewelry, cars (up to 6,000 of equity for a car; and only one car per person filing), and most equipment you might use for work. One of the other most common questions relates to your retirement accounts. All tax exempt plans and 401ks are also protected when you file bankruptcy. If you are seriously considering filing bankruptcy, but you are on the fence hung up about the thought of losing something, you should consider your options and be open to cleaning the slate while retaining some of your assets. Come in and lets us review your property to confirm what risks if any you have. Every person and family is different and you should double check with a qualified bankruptcy attorney before filing to ensure your assets are protected.

If you need more information about the bankruptcy process, if you qualify and what your situation will look like after filing bankruptcy- or any other questions about your assets and what you will be walking away with, give Dodge and Vega a call and schedule your free consultation today!

Come in for your free consultation to see what discounts and price you qualify for! Call us at 480-656-8333 any time night or day and we can get you scheduled to speak with one of our qualified bankruptcy attorneys.

I love the opportunity to go to court and put my money where my mouth is.

Be Prepared Before Filing Bankruptcy

No one ever wants to be put in a situation where they are drowning in debt. But it happens, and for most people, it takes a huge emotional toll. In fact, it ranks up there with divorce, death of a loved one and business failure. So, it’s essential that you carefully weigh your options and be prepared. Below are a few things you can do before you take any action:

  1. Organize your paperwork and Review your Finances: Make a list of all debts, from your mortgage to student loans to child support. It would also be helpful to get a copy of your credit report to check debts you may have forgotten. There are several websites that offer free credit reports every 12 months. For every debt, try to locate paperwork to verify the creditor and the amounts because you will need these if you decide to file bankruptcy.
  2. Look at Options to Reduce your Debt: Before you decide to file, try your best to pay off your debts. You may also want to talk with creditors about lowering interest rates or getting better terms. You may also need to take more drastic steps, such as finding different ways to supplement your income, removing unnecessary expenses, moving to a more affordable place, etc.
  3. Talk with a Financial Counselor: Many financial counselors can give you a different, unbiased perspective on your financial situation. They can also provide alternatives to bankruptcy and create a customized plan to get you out of the red. And they can give you encouragement and that extra kick in the right direction! There are many web-based companies that offer such services and can provide helpful information.
  4. Get professional help: If you’ve done everything you can and still can’t get your head above water, bankruptcy may be your best option. Filing is complicated and involves lots of paperwork and the potential for mistakes. So, it is essential to that you consult with a professional. Our bankruptcy team at Dodge & Vega, PLC, have years of experience and will walk you through the bankruptcy process to avoid potential mistakes and pitfalls. We strive to alleviate your stress during an overwhelming time.

Our lawyers at Dodge & Vega are absolutely the best.  Speak with them now over the phone or schedule an in person consult.

Does the word “Bankruptcy” scare you to hear? If you answered “yes”, trust me you are not alone! When it comes to bankruptcy- it does not need to be a quick decision, however you should make the choice yourself before, before getting to the point of having the choice made for you. If you have lost track of how much you owe and to who, you have bill collectors calling you hassling you about money, and you are possibly only making minimum monthly payments (or no payments at all sometimes!) then you might want to give a bit more thought into possibly filing for bankruptcy.

The longer you put this process off, the longer it will take to get you out of that never-ending hole you feel you are falling down. Some might choose to go with a debt consolidator, however if you are having a hard time making any sorts of payments now, this might not be the best option for you.

Although “bankruptcy” is a scary word and thought, it can usually give you a fresh start. You will no longer be receiving those annoying debt collector calls. Bankruptcy gives you a true chance to rebuild your financial credit! You can always call us here at Dodge & Vega to schedule a NO COST consultation with one of our attorneys. We will go over your finances and let you know what your debt relief options are.  Sometimes bankruptcy is the answer and sometimes it is not. Knowing all of your options is the first step to making the right decision for you and your family.

If a bankruptcy is your best option we will make it as affordable for you as possible with low upfront costs and affordable payments plan options that you choose! Our up front costs start as low as $0 dollars down. Call our office today and see what your options are!

Our lawyers at Dodge & Vega are absolutely the best.  Speak with them now over the phone or schedule an in person consult.

Filing for Bankruptcy can be a tough decision. Sometimes, it can feel like you’re alone and that you are the only one that’s experiencing financial hardships. This is simply not the case. Bankruptcy is a way to “start over” when you are in financial crisis and your debts becoming overwhelming. In fact, many people and even major companies have fallen victim to overwhelming debt. Four months into 2019, there have been reports that over 19 major retailers have filed for bankruptcy. Some of these retailers include: Beauty Brands, Gymboree, Charlotte Russe, and Payless Shoes. So, what does the bankruptcy process look like?

Well, there are many different types of bankruptcies that can be filed, depending on your household income, expenses, assets, debts, number of dependents and so on. The most common bankruptcies for individuals are Chapter 7 and Chapter 13. As per the Bankruptcy Abuse and Consumer Protection Act of 2005 (BAPCPA), consumers who file a Chapter 7 or Chapter 13 bankruptcy are required to complete a Bankruptcy Credit Counseling course with an approved non-profit counseling agency. Consumers must complete this mandatory counseling prior to filing their bankruptcy. Once after you have completed the credit counseling course and have determined that bankruptcy is your only viable option for relief from financial hardship, you can prepare and file the bankruptcy petition. This is the step, where most people decide to seek legal help. The forms can be complex, and they can be difficult to navigate through if you are not familiar with State exemptions and ways to protect your assets.

Then, after you file bankruptcy, you are required to attend a mandatory bankruptcy hearing to appear before the bankruptcy trustee – this can be a daunting and intimidating process. Let one of our experienced attorneys at Dodge & Vega, PLC help you to determine your rights under the Bankruptcy law and walk you through the bankruptcy process. If you have any questions regarding bankruptcy or have questions to determine if bankruptcy is right for you, our office offers FREE 30-minute consultations with an experienced bankruptcy attorney. Give us a call at (480) 656-8333 and let us know how we can help you improve your financial situation.

Or Contact our office online for your free Chapter 7 or Chapter 13 Bankruptcy consultation to find out if you can qualify for bankruptcy and/or what other alternatives are available to you if bankruptcy is not for you.

One of the most common concerns of homeowners who are considering filing for bankruptcy is whether or not they will lose their home if they file for bankruptcy. In many cases, you will not have to give up your home simply because you have found yourself in financial trouble, and have chosen to file for either Chapter 7 or Chapter 13 bankruptcy. There are certain circumstances which could lead to your property being foreclosed upon as well as alternatives that could be helpful, such as a short sale. If you are current on your mortgage payments, and you wish to continue living in your home, our firm may be able to help avoid losing the property.

Arizona law permits the complete exemption of certain properties providing their value does not exceed the limits as laid out in the Arizona statutes. To gather a more complete understanding on Arizona bankruptcy exemptions, and to determine if your home and property qualify for exemption, we recommend you contact our firm to discuss your situation with an experienced Mesa bankruptcy lawyer. The lawyers at our firm have more than 35 years combined experience helping clients navigate through a range of different bankruptcy situations. We know that each situation is different, and that is why we work closely with our clients to determine the course of action that will best suit their needs, and allow them to regain control of their finances.

If you are struggling with debts and believe that you will not be able to repay your creditors, it may be time to consider bankruptcy. Through Chapter 7 or Chapter 13, you may be able to finally secure the financial freedom for which you have been searching. Bankruptcy can be confusing, but with the assistance of a caring and proven legal counselor, you can take back control from your creditors and achieve debt relief. Every situation is unique, so it is best to discuss your circumstances with an experienced bankruptcy lawyer before making any decisions. Bankruptcy may be the right choice if the following statements are true of your situation:

  • You are purchasing even basic necessities with credit cards
  • You are borrowing from friends and family just to pay your bills
  • You have to live paycheck to paycheck
  • You are constantly being harassed by your creditors
  • You have to dip into your retirement or savings accounts to make ends meet
  • Your financial problems are making your life stressful and overwhelming
  • You are always worried about your debts and inability to pay your bills

Do those statements describe your family’s financial troubles? If so, do not hesitate to speak to a skilled legal counselor as soon as possible. Although you can file for bankruptcy on your own, it is important to be fully informed before making any decisions, so that you are confident filing is the right choice for your family.

Chapter 7 vs. Chapter 13

After assessing your circumstances, if you believe bankruptcy is right for your family, the next step is determining which Chapter is best for your debt, with the help of a knowledgeable attorney. Chapter 7 uses the liquidation of nonexempt assets to repay creditors, and after the liquidation process is complete, the filer is released from the remaining balances of most of their unsecured debts. In
Chapter 13 bankruptcy, the filer works with their attorney and a court-appointed bankruptcy trustee to create a monthly repayment plan through which they will repay their creditors over a 3 to 5 year period.

There are a number of benefits to each Chapter, but there are also implications that must be considered carefully before making your choice. If you are interested in bankruptcy to help your family overcome debt and regain control of your financial future, our team would be proud to help. Our attorneys at Dodge & Vega, PLC have helped countless clients in Mesa and all over the state through the bankruptcy process, and we can assist you with exceptional legal counsel during this difficult time. To determine your available options and learn how bankruptcy could benefit your financial situation, please call our team at your earliest convenience!
