Take for instance, DUI checkpoints. At the DUI checkpoints several police agencies will target drunk drivers in a particular area in the hopes of arresting a person who is under the influence. For example, a Mesa Police Officer can arrest a person in the Town of Gilbert. They still have to have probable cause, and they have to cite you into the correct court. My lawfirm once had a client who was arrested by a Chandler Police Officer for a DUI. Our client was charged with DUI in the Chandler Municipal Court.

Having done that we could then review the police report associated with our client’s arrest. Once we received his police report, we discovered that the Chandler Officer was part of a DUI task force that was taking place in the City of Mesa and had actually pulled my client over in the City of Mesa. As a result, we contacted the Chandler City Prosecutor and asked him to dismiss the charges, which he was obligated to do since the Chandler Municipal Court had no jurisdiction over the case. Although an officer can arrest you and charge you in any jurisdiction, they have to do in the correct Court. The Courts only have control over those offenses that occur within their jurisdiction.
