I have been in the legal field now for over 20 years. People have always asked me if a police officer can arrest or stop them anywhere in the State of Arizona.  The short answer is yes.  Take for instance, DUI checkpoints.  At the DUI checkpoints several police agencies will target drunk drivers in a particular area in the hopes of arresting a person who is under the influence.  For example, a Mesa Police Officer can arrest a person in the Town of Gilbert.  They still have to have probable cause, and they have to cite you into the correct court.  My lawfirm once had a client who was arrested by a Chandler Police Officer for a DUI.  Our client was charged with DUI in the Chandler Municipal Court.

As an expert criminal defense team, we decided the best strategy for our client was to plead him not guilty and set the case for a Pretrial Conference. Having done that we could then review the police report associated with our client’s arrest.  Once we received his police report, we discovered that the Chandler Officer was part of a DUI task force that was taking place in the City of Mesa and had actually pulled my client over in the City of Mesa.  As a result, we contacted the Chandler City Prosecutor and asked him to dismiss the charges, which he was obligated to do since the Chandler Municipal Court had no jurisdiction over the case.  Although an officer can arrest you and charge you in any jurisdiction, they have to do in the correct Court.  The Courts only have control over those offenses that occur within their jurisdiction.  If you will want to have an experienced attorney who will be able to spot these small details and work to defend you aggressively, contact our office and set up a consultation with our incredible Criminal Defense Team.

I love the opportunity to go to court and put my money where my mouth is.

Getting into a motor vehicle these days can be one the life-threatening events that could happen to us all day, and we take this chance every time we get into the driver’s seat. Did you know that in 2017 Arizona reported a total of 127,064 collisions and 919 of them being fatal? For at least the last 5 years (since 2014) our crash and fatality rate has increased, with the most recent of a 4% increase from 2017 to 2018. Take extra precaution when taking a drive, you never now what could happen. What are some things you can do to prepare and protect yourself you ask? Personally, looking at these statistics makes me think of a few things.

My first question to myself is, “Do I have enough insurance coverage? If I got in an accident would I be covered?” These are things you want to make sure you go over with your insurance broker, seeing as having “better” coverage than what you might need may benefit you in the long run. The next think I think of, “If I was in a fatal accident, what would happen? Where would my children go? Would they be okay? What will happen?” This makes me remember why I need to have my Will and Power of Attorney prepared. With these documents in place, it will ensure that things are not in a shamble if something happens to me! If I end up in the hospital, they will know who is supposed to make decisions for me on my behalf, and they will know what I would want. Last thing I think of, I better have my Husband and my attorneys at Dodge & Vega on “speed dial” just in the event this happens to me. Be safe out there!

Perhaps you were unaware that you might need a personal injury lawyer. I know before I started working in a law firm, that I did not know how sideways insurance companies can be! I was always under the impression (naively) that the insurance companies were there for the best interest of both parties, and just wanted to make sure that all parties were well taken care of. Boy, was I wrong. If you didn’t already know, the main objective of an insurance company and the adjuster, is to settle the claim as fast and as cheap as possible, even if that means telling you that your claim is BS and not worth much if anything at all.  No matter how nice and friendly they try to appear they have zero intention of doing whats best for you.  Its just sad to realize and experience the truth of that.

If you find yourself with an injury related accident, that you feel is not your fault, you should ALWAYS consult with an attorney. At our firm, we have no cost consultations available for any potential personal injury client. What do you have to lose now? At this point, you are hurt and can be left with a loss in job profits along with bills to pay, kids to take care of and you do not know what to do at this point. You very well might have a great claim that can possibly pay off your medical bills you incurred from the injury, and also pay for your property damage at the very least. Yes, it’s okay you can take a deep breath now!

Bottom line, if you have been in any kind of injury related accident do not hesitate to contact an attorney right away.  You’ll need to discuss your particular situation before making any quick decisions to deal with the insurance company or the adjuster on your own!

Pre Trial Prep Deadlines

While not all family law cases progress to trial, if you find yourself on the trial path, there is a considerable amount of preparation required to adequately strengthen your case in advance of a trial date. Did you know that any witnesses, including friends, family members, teachers, doctors, experts, etc., whom you intend to call for testimony at trial must be disclosed to all other parties involved in your case no less than sixty (60) days before trial? That disclosure needs to include not only their name, but their complete contact information and the substance of their intended testimony. Additionally, any documents you plan to submit as exhibits at your trial to support your requests/positions have their own deadlines for disclosure. Disclosure in family law cases means revealing to all other parties in the case any facts, data, legal theories, witnesses, documents and other information that are relevant to the case. The disclosure rule (Rule 49, Arizona Rules of Family Law Procedure) is intended to ensure that each party to the case is fairly informed of and provided with all relevant documents and information. Discovery, on the other hand, is a process of investigation and can take on various forms in family law cases, such as uniform interrogatories, request for production, request for admission, non-uniform interrogatories, subpoenas, etc. The discovery and disclosure rules are designed to ensure the swift, accurate, and fair determination of your case. Check out the link below to the Arizona Rules of Family Law Procedure.

It’s all a bit overwhelming, isn’t it? While preparing for trial certainly can be overwhelming, it doesn’t have to be! Because that’s what we are here for and, get this, we love it!!! I personally have worked exclusively in family law for nearly 13 years and the discovery and disclosure process is my life blood. No matter where you are in the process of your case, whether you are just starting out or already have the ball rolling, we have dedicated staff ready to take the burden off your shoulders and guide you to the finish line. If you’re interested in getting the monkey off your back, contact us at (480) 656-8333 or via email to [email protected]
