As most individuals are aware, there is a pandemic that is occurring all over the world in relation to the COVID-19 Virus, a.k.a. the Corona Virus. The schools in Arizona have been ordered to be shut down and many clients have called our office asking how this affects their parenting time if the other parent is now using this virus as a way to not allow them to have their parenting time. We have informed our clients that it is a case-by-case situation. We always tell our clients that if they are amicable and are able to reach an agreement and work out a different parenting time schedule, then do it!

Coronavirus Should Not Limit Parenting Time – Only a Court Order

However, if the parents are unable to reach an agreement, then the Order still stands. There is nothing in an Order which states if a child is sick or there is a potential for a child to get sick then Dad does not get his parenting time or Mom does not get her parenting time. In addition, there is no reason to withhold a child from the other parent for a “potential” of the child getting sick. It would seem like now more than ever that parents should work together to make sure each parent has contact with their children but unfortunately this is not always the case. There are parents who have very limited contact with their children and to take away that limited contact out of a fear of something that may or may not happen will only result in criminal charges or the filings with the Court in family law matters to increase. I have clients who have asked our office, “what if I have sole legal decision-making, can I say no to Father’s parenting time?” The short answer is NO! Pursuant to A.R.S. §25-401, sole legal decision-making means that “one parent has the legal right and responsibility to make major decisions for a child” but this does not mean you have the ability to dictate or interfere with the parenting time orders.  You cannot change a parenting time schedule without the Court modifying that order and I can tell you most judges are not going to allow parents to interfere with court ordered parenting time out of a fear “something might happen” when in truth, there is no way to determine that it will happen.

  • No Entry: We are limiting non-employees from entering our building. Clients who must drop off documents, payments, etc. can do so with our secure document “night drop” box we have now installed right next to our front door. Vendors will drop off in the front of our building as well.
  • Court Hearings: We will continue to appear as scheduled in court. However, whenever a telephonic appearance can be granted on a case by case basis by your judge we will pursue asking for one. We will seek to obtain permission to appear telephonically for our Dodge & Vega team as well as our clients. Please continue to appear in person in court as scheduled unless notified by our office that you may appear telephonically.
  • Physical Office Presence: We have instituted a remote working policy for those who can at Dodge & Vega. However, we remain open during our regular business hours with employees in our office still working on your case. We will continue to prepare and advance your case and may do so both remotely and physically in our office.
  • Cleaning: We have strengthened our cleaning and sanitation practices all throughout the office and beyond with personal work spaces sanitized and cleaned several times per day.

It can often be difficult dealing with the other parent of your child and it can be even more difficult when you are faced with having to go to court because your child is telling you they are being hurt by the other parent or mommy/daddy is doing drugs. You will often feel like no one is listening to you and you fear that returning your child to the other parent will result in the child being hurt, ending up in the hospital or worse. When do you file for emergency custody of your child? There is no right answer other than to say “NOW!” Now is the time to make a move. All too often parents believe they shouldn’t do anything because “I’ve called DCS and they won’t do anything, so a judge won’t either.” This is incorrect. The standard for the Department of Child Safety (DCS) to do something and how a judge will view things can be very different. I recently had an old client call me and ask what they should do when his son told him he was having to fight his mommy to protect his sister because his mommy was hurting his sister. My response was “let’s go to Court and get your son and daughter out of that situation now.”

The standard a judge has to consider for granting emergency orders is whether there will be some kind of harm that will result to the child if the court does nothing. Rule 48 of the Arizona Rules of Family Law Procedure says that the Court can award temporary orders without notice or on an emergency basis if the parent shows “…specific facts that if an order is not issued…the child will be irreparably injured, or irreparable injury, loss or damage will result…” So, when you seek emergency custody of your child be specific as possible in your request and tell the judge what will happen or what has happened that will result in an injury to the child if the Court does nothing.

Rule 48. Temporary Orders Without Notice*

(a) Filing and Timing. A party may request temporary orders without notice by filing a verified motion, along with a proposed form of orders and a notice of hearing on the motion. A motion may be filed at the same time or after filing an initial pre-decree or post-decree petition.
(b) Grounds. A court may grant temporary orders without written or oral notice to an adverse party or that party’s attorney only if the verified motion:
(1) clearly shows by specific facts that if an order is not issued before the adverse party can be heard, the moving party or a minor child of the party will be irreparably injured, or irreparable injury, loss, or damage will result to the separate or community property of the moving party; and
(2) the moving party or attorney provides written certification of the efforts to give notice to the other party, or why giving notice should not be required.
(c) Orders. Temporary orders without notice must specify the injury, loss, or damage and why it is irreparable, and state why the court granted the orders without notice. Temporary orders expire at the date and time set for hearing on the motion unless the court extends the time for good cause.
(d) Hearing. An evidentiary hearing must be set on the motion not later than 10 days after the order’s entry, unless the court extends the time for good cause. The nonmoving party may request an earlier evidentiary hearing with reasonable notice as the court directs.
(e) Service. The order and notice of the evidentiary hearing must be served as soon as possible after the order’s entry or as the court directs.
(f) Bond. No bond is required for temporary orders unless the court finds a bond appropriate.

In Arizona, both Chapter 7 and Chapter 13 bankruptcy is used to discharge debt and give debtors a fresh start. However, Chapter 7 bankruptcy is the quicker and cheaper route to your debt free life. It is by far the most preferred bankruptcy for consumers and the average American out there. Because it is the most preferred bankruptcy method, there have been quite a few people over the years who have tried to fraudulently rack up debt and file bankruptcy even though they had plenty of money to pay their debts. So in 2005, to deter fraud, the Bankruptcy Court created the “Means Test” under the Bankruptcy Abuse Prevention and Consumer Protection Act. Essentially the Means Test determines whether your Chapter 7 filing is “presumed to be abuse.” It is the hurdle you must jump to file your Chapter 7 bankruptcy. When you file a Chapter 7 bankruptcy most all of your debts can be completely wiped out. So if a person filing bankruptcy actually has the money to pay back their debts, filing for Chapter 7 relief would be presumed to be abuse, or unfair. If you fail the means test then you most likely can still file a bankruptcy, but this time it would need to be a Chapter 13 bankruptcy.

The Means Test itself requires you to be poor enough to qualify for Chapter 7 bankruptcy in Arizona. There are average income levels you must fall under and/or use in calculating what necessary living expenses are allowed for a family of your size in your same county. The test is also used to determine whether or not your income could be used to pay off debts. Unless otherwise exempt, you must qualify under the bankruptcy Means Test in Arizona to even file for Chapter 7 bankruptcy relief. How do you know if you are exempt? You may be exempt from the Means Test if what you owe is primarily debt all based on your own business. For example, if you are self employed and you have a business line of credit and business credit cards, business leases, etc. and that is all more of a percentage of debt than your personal credit cards, etc. then you may be exempt from the Means Test. The money you lost when the company filed for bankruptcy would also be business debt. Other exemptions specifically relate to falling into debt during military service for those such as disabled veterans or active duty National Guard/Reservists.

Arizona Bankruptcy Means Test Calculator

Like many other things in our culture, there are no shortage of Means Test calculators available all over the internet. It is important that no matter which Arizona Means Test Calculator you use, that it is up to date with the correct figures according to bankruptcy laws.

Step 1. Determine whether your income is below Arizona’s median income level. Arizona bankruptcy law requires you to look at the 6 months of your income immediately prior to your filing. Calculate your monthly income for the six months before filing for bankruptcy and compare it to the median income for households of your size in Arizona (see the above chart). Ensure that you are correctly calculating your income and that you are including ALL of your various income when comparing it to the income levels in Arizona. If you fall below the income levels of households of your size in Arizona, then you have passed the Arizona Means Test and automatically qualify for Chapter 7 bankruptcy relief! However, if your income ends up being above the median income level in Arizona, then you will need to complete the Means Test Calculation bankruptcy form.  This is where it can get tricky. Any excess income above and beyond what Arizona Bankruptcy law deems as reasonable and necessary living expenses (allowable living expenses) is presumed to best used to pay towards your debts. You can see how important it is to make sure you have the correct information with your allowable living expenses. All of this because according to the “math” you have money left over to pay down your own debt.

There are too many examples to give for every type of property, but one common question we get is about your house. For example, the federal exemptions allow you to keep $150,000 worth of equity in a home (if owned outright), meaning you don’t have to lose your home just because you are filing bankruptcy. There are other exemptions regarding your household goods, clothes, jewelry, cars (up to 6,000 of equity for a car; and only one car per person filing), and most equipment you might use for work. One of the other most common questions relates to your retirement accounts. All tax exempt plans and 401ks are also protected when you file bankruptcy. If you are seriously considering filing bankruptcy, but you are on the fence hung up about the thought of losing something, you should consider your options and be open to cleaning the slate while retaining some of your assets.
